1. General
These Terms and Conditions ("Terms") govern your use of this website and any services, coaching, personal training, digital products, memberships, programs, or educational content provided by Katja Zumbühl / Body & Balance ("we", "us", "our").
By accessing this website, purchasing a service, or participating in any offer, you agree to these Terms.
If you do not agree, please refrain from using this website or purchasing our services.
2. Services & Offers
Body & Balance provides health, fitness, nutrition, and educational services, including but not limited to:
- Online personal training
- In-person personal training
- Nutrition coaching and guidance
- Digital programs and memberships
- Educational content (podcast, guides, resources, ebooks, recipe books, training plans)
- Lifestyle and habit coaching
- Workshops or events
All services are educational and supportive in nature.
We do not provide:
- medical treatment
- psychological therapy
- diagnosis
- physiotherapy
- licensed dietetic treatment
- medical nutrition therapy
Any information provided is not a substitute for professional medical advice.
3. Health & Personal Responsibility Disclaimer
By participating in any training, coaching, fitness, or nutrition service, you acknowledge that:
- physical exercise carries inherent risks
- results vary between individuals
- you participate voluntarily and at your own responsibility
- you are responsible for consulting a qualified healthcare professional where appropriate
You confirm that you are physically and medically able to participate in exercise and nutrition-related activities.
You remain fully responsible for your own health, wellbeing, decisions, implementation, and physical condition.
We do not guarantee specific physical, aesthetic, or health outcomes.
4. Eligibility
By purchasing or using our services, you confirm that:
- you are at least 18 years old
- you have legal capacity to enter agreements
- the information you provide is accurate and current
5. Payment Terms
All prices are stated in the currency presented at checkout and include VAT where applicable under Swedish and EU law.
Payment is due at the time of purchase unless otherwise agreed in writing.
For payment plans:
- all scheduled payments remain legally due
- missed payments may result in suspension of access
- failure to complete payments does not cancel your payment obligation
6. Recurring Subscriptions & Cancellation
Some services, including The Consistency Code, are billed on a recurring monthly basis.
Your subscription automatically renews each month at the price shown at checkout, until cancelled.
You may cancel your subscription at any time. Cancellation requires 30 days' written notice before your next scheduled billing date. If notice is given with less than 30 days remaining before the next billing date, one further payment will be processed, and your subscription will end after that period.
You will retain full access to the service through the end of your current paid period.

7. Digital Products & Online Programs
Digital products, memberships, and online programs may include immediate access to downloadable or streamed content.
By purchasing and accessing digital content immediately, you expressly consent to waive your statutory 14-day right of withdrawal in accordance with EU Directive 2011/83/EU Article 16(m).
Access instructions are delivered via email or platform login after purchase.
8. Personal Training & Coaching
Online and in-person coaching services are collaborative and educational.
Clients are responsible for:
- following guidance safely
- communicating injuries, limitations, or medical conditions
- exercising within their own capacity
We reserve the right to refuse or discontinue services if participation may present a health or safety risk.
In-person sessions may be rescheduled or cancelled with reasonable notice where necessary.
9. Refund Policy
Due to the nature of digital products, memberships, coaching services, and reserved training capacity:
- all purchases are non-refundable
- unused sessions are non-refundable unless otherwise agreed
- exceptions apply only where required by mandatory consumer protection law
If no digital access has been provided and withdrawal is requested within the statutory period, applicable EU consumer rights will be respected.
10. The Consistency Code Results Guarantee
The Consistency Code includes a voluntary 3-Month Results Guarantee subject to the conditions below.
Clients may apply for a refund if they have completed a minimum of 3 consecutive months inside The Consistency Code and have followed the coaching process consistently without seeing measurable progress.
To qualify for the guarantee, the client must:
- remain enrolled in The Consistency Code for a minimum of 3 consecutive months
- complete weekly check-ins consistently and honestly
- submit requested progress photos
- follow the personalised training program consistently
- follow the provided nutritional guidance consistently
- communicate openly regarding challenges, limitations, or adherence issues
Measurable progress may include, but is not limited to: body composition changes, progress photo changes, strength improvements, fitness improvements, measurement changes, and consistency improvements and habit development.
Refund requests will not be approved where:
- weekly check-ins were missed
- progress photos were not submitted
- coaching guidance was not followed consistently
- the client discontinued participation before completing 3 months
- lack of results is connected to non-adherence to the program
All refund decisions are made at the sole discretion of Katja Zumbühl / Body & Balance based on documented participation and progress tracking throughout the coaching period.
The purpose of this guarantee is to support clients who fully commit to the coaching process provided.
11. Intellectual Property
All content provided through Body & Balance, including but not limited to training plans, videos, guides, educational materials, branding, podcast content, recipes, frameworks, and written resources, remains the intellectual property of Katja Zumbühl unless otherwise stated.
You may not reproduce, distribute, resell, share, modify, or commercially use any materials without prior written permission.
12. Testimonials & Marketing
We may share testimonials, reviews, or client experiences for marketing and educational purposes.
By voluntarily submitting feedback, testimonials, tagging us publicly, or sharing your experience, you grant permission for reasonable use of this content in marketing materials, social media, and website communication.
No specific results are guaranteed.
13. Data Protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Swedish data protection laws.
Personal data is used solely for service delivery, communication, administration, and legal obligations.
We do not sell personal data.

14. Limitation of Liability
To the fullest extent permitted under Swedish law, Katja Zumbühl / Body & Balance shall not be liable for indirect losses, consequential damages, injuries arising from misuse of information, or decisions made based on educational content.
Participation in training, coaching, nutrition guidance, and exercise activities is voluntary and undertaken at your own responsibility.
15. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Sweden.
Any disputes shall fall under the jurisdiction of Swedish courts unless otherwise required by mandatory consumer protection regulations.
